The U.S. interpretation of the ban on cruel, inhuman, and degrading treatment (CIDT) is that it bans anything banned by the 5th, 8th, and 14th amendments. They've argued that the ban on cruel and unusual punishments only applies to punishments after convictions, and that 5th and 14th amendment rights are only relevant in court.<BR/><BR/>They get away with it because they broadly assert rights that sound good in the press. Like that the president is the only one who can do foreign policy. Or saying "Article II powers" without specifying them. Or they get ruled against in the Supreme Court and just ignore it, or get Congress to pass a law. The neocon push to assert US power abroad would be brought under control by the international community if not for the sovereigntists or by Congress if not for the unitary executive taking over.
